It doesn't pay to antagonize the
federal government. It is far wiser to
understand the laws and to follow them. This particularly true where the law is very clear about
expectations.Even the
"stay-at-home mom" knows what an I-9 is and that every employee must
complete one and have acceptable identification. The required forms of identification are
listed in the I-9 packet! How much
simpler could it be for the employer?
For the following company, it either wasn't
clear enough, or the company simply chose to disobey.A very poor decision.
An I-9
audit, followed by an Immigration & Customs Enforcement team search was
resolved when the employer consented to pay $1.5 million to satisfy criminal
charges because the company employed workers who did not have credible
documents. Above and beyond the financial hit, this cost the company
because:
·It will have to follow a two-year compliance
plan, which the court may review.
·It will begin using E-Verify and SSN
verification on all new hires and current employees.
·It will provide training on a regular basis
to ensure employees understand their rights and have a grasp on lawful hiring
practices.
·They will be audited annually.
·The will provide their Spanish speaking
employees translators who will help in completing I-9 paperwork.
Doing the WRONG thing can bring an
employer to its knees...or crush it.
